GNSS uniform governance structure: The way of risk management

摘 要
As an ambitious project with the goal of providing global public good, Global Navigation Satellite Systems (GNSS) demonstrate not only how modern technology can serve mankind but also how powerless it is in the face of technical vulnerability, financial pressure, institutional challenges, and legal inadequacy. Although the inter- national community has been moving towards an international instrument with legal binding effect for GNSS, particularly its civil liability issue, the path towards such an instrument has been difficult because of the objections from the main GNSS powers. This article proposes a uniform governance structure over GNSS as a more feasible way to guide both international organizations and the primary States to build an efficient institutional framework and a comprehensive legal system in the context of GNSS so as to balance the interests of the providers and the users and to manage GNSS risks. On the one hand, the institutional framework should focus on what organizations, either international or national, should be established or involved and what their respective responsibilities should be; on the other hand, the legal system should pay more atten- tion to which legal aspects regarding GNSS should be included in the international conventions and national legislation.
